Terms and Conditions

Please read these terms carefully before using the LoPaisa platform.

GSHTISH TECH SOLUTIONS PRIVATE LIMITED (hereinafter referred to as "we" or "our Company") is a company legally incorporated under the laws of India, with its registered address at: Co Dot Space, 6th Floor, Lotus Tower, No. 85, Mount Road Anna Salai, Guindy, Chennai-32, Tamil Nadu, Pin Code 600032. We are the owner of the website under the brand name "LoPasia" (Website URL:www.lopaisa.in , collectively referred to as the "Platform" hereinafter). As a user of this Platform (hereinafter referred to as "User" or "you"), you confirm that the purpose of LoPaisa's services is to provide users with access to various financial products, including but not limited to personal/consumer loans. The aforementioned products are provided by LoPaisa's Financial Partners, aiming to facilitate the smooth conduct of lending and related financial activities. It is hereby clarified that the term "User" or "you" as used in these Terms and Conditions includes any individual or entity that accesses this Platform solely for browsing the Platform or applying for products from LoPaisa's Financial Partners. Your use of this Platform shall be deemed as your having read, understood and agreed to comply with the following disclaimers and terms and conditions (hereinafter referred to as "these Terms"). These Terms, together with the Privacy Policy published on the Platform (hereinafter referred to as "Privacy Policy"), jointly govern your use of this Platform. If you do not agree to any content of these Terms, please do not use this Platform.

1. General Provisions

As a service provider, LoPaisa is committed to building a connection bridge between banks or Non-Banking Financial Companies (NBFCs) registered with the Reserve Bank of India (hereinafter referred to as "Financial Partners" or "Lenders") and users intending to apply for financial products. The final decisions related to lending shall be independently made by the Financial Partners (in the capacity of Lenders) and users (in the capacity of Borrowers) in accordance with their respective wishes.

LoPaisa is a private limited company registered under the Companies Act, 2013. It only acts as an intermediary service organization providing platform support for individuals or entities in need of financial products and does not directly provide any financial services to users. As a trading platform connecting borrowers and cooperating lenders, this Platform helps users obtain lending and financial-related services provided by cooperating parties. LoPaisa is not a registered institution of the Reserve Bank of India, nor is it a financial institution as defined by the Companies Act, 2013, the Banking Regulation Act, 1949, or any other existing laws of India. It is not a deposit-taking company or a chit fund company, nor does it provide any investment schemes that meet the requirements of the existing laws and regulations of India.

If you intend to apply for any financial product displayed on the Platform, you are required to submit the relevant necessary information. Our staff will contact you by phone or email to clarify your specific needs.

The scope of services provided by LoPaisa includes but is not limited to the following contents:

  • Assisting LoPaisa's cooperating lenders in disbursing loans to users;
  • Helping users obtain credit cards and other financial products from LoPaisa's cooperating lenders;
  • Assisting users in connecting with insurance products provided by cooperating parties;
  • Assisting users in obtaining credit reports through LoPaisa's authorized cooperating parties. After receiving the credit reports issued by the authorized cooperating parties, LoPaisa will conduct real-time monitoring and updates on the credit reports obtained by users through this Platform;
  • Providing users with financial capability verification support services;
  • Obtaining users' income and expenditure data by parsing bank SMS and connecting with third-party service providers' systems, and providing users with income and expenditure analysis services;
  • Generating users' social scores based on the information of users' Facebook, Twitter, Linkedin and other social media accounts bound to their Platform accounts.

If you have registered for the "Do Not Disturb" service with your telecommunication service provider, you shall take all necessary measures to allow our staff to contact you by phone to inform you of the detailed information of various financial products; you confirm that such calls are all based on your act of providing information to us, and you shall not file a complaint with the relevant competent authorities regarding such calls.

To provide the aforementioned Services, LoPaisa will share your information with multiple lenders and other relevant entities within the scope already notified to you, and may conduct multiple credit checks to select the product plan that best meets your needs. The collection, storage, use and transmission of the information provided by users shall be governed by the Privacy Policy.

2. Eligibility Requirements

The Platform User solemnly declares and agrees that: he/she is a natural person/legal entity, has reached the age of 18, and has the capacity for civil rights and civil conduct to enter into contracts in accordance with the laws of India. Users may use our services in accordance with the specific provisions of these Terms. By registering on the Platform, the User hereby undertakes to accept and comply with all the contents of these Terms. If the User violates any provision of these Terms or any other agreement entered into through this Platform, LoPaisa has the right to independently decide to terminate the User's membership, delete their account information and all contents or information posted on the Platform, and/or prohibit the User from using or accessing this Platform at any time (whether with or without prior notice), including but not limited to taking such measures when LoPaisa has reasonable grounds to determine that the User is under the age of 18.

3. Acceptance of These Terms

As a Platform User, you have agreed to these Terms and the relevant provisions stated in any other location on the Platform (including but not limited to the disclaimers published on the Platform). It is recommended that you carefully read and fully understand these Terms. If you are unwilling to accept these Terms, please do not use the Platform.

LoPaisa reserves the right to modify, alter, add to or delete the contents of these Terms at any time without prior written notice to users. It is the User's obligation to regularly review the updated contents of these Terms. After the revision of these Terms, your continued use of the Platform shall be deemed as your acceptance of the revised Terms.

4. Your Account

If you wish to use this Platform, you need to register and maintain an account, and provide relevant information and details in accordance with LoPaisa's requirements, including but not limited to your name, email address, contact number and other necessary information. You are responsible for ensuring the confidentiality and security of your account and password, shall be liable for all activities occurring through your account, and shall restrict access to your computer to prevent unauthorized use of your account. You agree to be fully responsible for all activities arising through your account or password. You shall take all necessary measures to ensure the confidentiality and security of your password. If you have reason to suspect that your password has been known to others or there is a possibility of unauthorized use, you shall immediately inform us. Please ensure that all information provided to us is true, correct, accurate and complete. If LoPaisa discovers or has reasonable grounds to suspect that the information provided by you is false, inaccurate or incorrect, it has the right to immediately terminate your account without notifying you in this regard. If any change occurs to the information provided by you when registering on the Platform, you shall immediately notify us of such change. After logging into your account, you can access and update most of the submitted information through the "Dashboard" area, or contact us by sending an email to service@lopaisa.in for updates. If you fail to notify us of any changes to the information, LoPaisa will continue to use your original information already in our possession. The right to use this Platform belongs to the User personally and shall not be transferred to any other individual or entity.

You shall always comply with the provisions of these Terms. Any violation of these Terms may result in LoPaisa terminating your account, and our Company has the right to pursue your corresponding civil and criminal liabilities in accordance with the laws of India.

You further understand and agree that the disbursement of a loan, the approval of a credit card, or the uninstallation of the LoPaisa mobile application from your mobile device will not automatically revoke any consent you have given to us in accordance with the Privacy Policy. 5. Privacy Protection

To provide Services, LoPaisa will collect relevant information about you. The use of your personal information by LoPaisa shall be governed by the Privacy Policy published here on this Platform.

6. License and Platform Access Rights

LoPaisa grants you a limited license to access and use this Platform for the purpose of obtaining Services. However, without the express written consent of LoPaisa and/or its affiliates (if applicable), you shall not download any materials from the Platform (except for page caching), modify the Platform or any part thereof. Unauthorized access to this Platform or any networks, servers or computer systems connected to this Platform is prohibited. Any attempt to modify, adapt, translate or reverse engineer any part of the Platform, or reformat or frame any part of the Platform's pages is prohibited. This license is non-transferable and does not permit any resale or commercial use of this Platform or its contents; it does not permit the downloading or copying of account information for the benefit of any other person other than your authorized use; it does not permit the use of data mining, robots or similar data collection and extraction tools. Without the express written consent of LoPaisa and/or its affiliates (if applicable), you shall not reproduce, duplicate, copy, sell, resell, access, distribute or otherwise use this Platform or any part thereof (including but not limited to any copyrighted materials, trademarks or other proprietary information) for any commercial purpose. Any unauthorized use of this Platform will result in the immediate termination of the license granted by LoPaisa.

7. Platform and Account Monitoring

LoPaisa has the right to monitor the contents of the Platform at any time, including the information provided by you in your account. The purpose of Platform monitoring is to verify the authenticity of the information provided by you and ensure that all users comply with the provisions of these Terms. In accordance with the provisions of these Terms, LoPaisa has the right to delete any non-compliant content that violates these Terms, or submit such information to the relevant government departments in accordance with the procedures stipulated by the existing laws of India.

8. Service Suspension

LoPaisa may stop providing Services and terminate the right to use the Platform at any time without notifying you of the termination. Unless LoPaisa notifies the User otherwise, upon any termination: (a) the rights and licenses granted to you under these Terms will immediately terminate; (b) the User must stop using the Platform. LoPaisa reserves the right to suspend or terminate the provision of any Service. If such a decision is made, it shall not be liable or responsible to the User in any way.

9. Limitation of Liability and Disclaimer of Warranties

Notwithstanding any contrary provisions in these Terms, LoPaisa and its affiliated companies, subsidiaries, managers, directors, employees or any related parties shall not be liable to you or any third party for any indirect, incidental, special or consequential damages, or any loss of income or profits arising out of or in connection with these Terms. To the maximum extent permitted by law, you agree to release, discharge and indemnify LoPaisa and its affiliated companies, subsidiaries, as well as their respective directors, managers, employees and agents, from any and all claims, losses, damages, liabilities, expenses and causes of action arising out of your use of this Platform.

LoPaisa makes no representations or warranties regarding the financial products provided by its cooperating financial service providers, banks or Non-Banking Financial Companies (NBFCs), nor does it endorse any products provided by Lenders. LoPaisa shall only be liable for providing the Services stipulated in these Terms. All liabilities and obligations related to the financial products provided by cooperating Lenders shall be governed by the separate agreements entered into between such Lenders and the Users.

LoPaisa makes no representations or warranties regarding the accuracy, reliability, completeness, timeliness and/or up-to-dateness of any content, information, software, text, graphics, links or communications provided or obtained through the Platform, nor does it warrant that the operation of the Platform will be error-free and/or uninterrupted, or that any errors will be corrected. The Services are provided on an "as is" and "as available" basis. LoPaisa expressly disclaims all warranties of any kind with respect to the Services and all information, products and other contents (including those provided by third parties) included in or accessible through the Services, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Therefore, LoPaisa shall not be liable for any monetary or other losses incurred by you due to the delay, failure, interruption or corruption of any data or other information transmitted in connection with the use of the Platform; and/or any interruption or errors in the operation of the Platform.

In addition, LoPaisa does not make the following warranties:

  • The Services will meet your requirements.
  • The results that may be obtained from the use of the Services will be accurate or reliable.
  • The quality of any products, services, information or other materials purchased or obtained by you through the Services will meet your expectations.

You shall be fully responsible for any damage to your computer system or loss of data resulting from the download of any such materials. Any oral or written advice or information obtained by you from LoPaisa or through the Services shall not constitute any warranty not expressly stated in these Terms.

LoPaisa and its affiliated companies, subsidiaries, managers, directors, employees or any related parties shall not charge any fees to customers for the provision of Services. If you receive any communication from an individual claiming to represent LoPaisa requiring you to pay fees for applying for financial products, please contact us at service@lopaisa.in.

This limitation of liability clause shall prevail over any other conflicting or inconsistent provisions in these Terms. You shall take precautions to ensure that whatever you select for your use is free of items such as viruses, worms, malware, Trojan horses and other destructive programs.

10. Indemnification

You agree to indemnify, defend and hold harmless LoPaisa and its affiliates, contractors, employees, managers, directors, agents, as well as its third-party partners, licensors and collaborators, from and against any and all claims, demands, losses, damages, liabilities, costs and expenses (including but not limited to legal fees and expenses) arising out of or in connection with your use or misuse of the Services or the Platform, your violation of these Terms, your breach of the representations, warranties and commitments made during the account registration process, your infringement of any intellectual property rights or other rights of any individual or entity, or the posting/transmission of threatening, defamatory, obscene, harassing or offensive materials by you on the Platform. If any matter arises for which you are required to indemnify LoPaisa, LoPaisa has the right to assume the exclusive defense and control thereof (at your expense), including the right to settle, and you agree to cooperate with LoPaisa in the defense and settlement of such claims. LoPaisa will use reasonable efforts to notify you of any third-party claims, actions or proceedings subject to the foregoing indemnification upon becoming aware of them. This clause shall survive the termination of these Terms.

11. Advertisers/Third-Party Links on the Platform

LoPaisa shall not be liable for any advertisements contained on the Platform. LoPaisa has no control over and shall not be liable for the content of any website or mobile application linked to on the Platform. Such linked websites and mobile applications are provided "as is" solely for the convenience of Users, without any express or implied warranties regarding the information provided therein. LoPaisa does not endorse or recommend any third-party websites or mobile applications linked to on the Platform.

12. Acknowledgments

You acknowledge that LoPaisa is solely a platform focusing on providing financial service matching for users and does not engage in the business of granting loans or providing other financial products. You acknowledge that the use of financial products is entirely based on the negotiation results between you and LoPaisa's Financial Partners, and LoPaisa and its affiliates, contractors, employees, managers, directors, agents, as well as its third-party partners or licensors, shall not be liable for any financial products obtained or intended to be obtained by Users or any related assistance. You acknowledge that LoPaisa shall not be liable for any claims or damages arising from the use of financial products. LoPaisa does not guarantee or warrant the performance capacity of any service providers/Financial Partners offering various financial products or services on the Platform in any way.

13. Applicable Law

Your use of the Platform and the contents of these Terms (including the Privacy Policy) shall be governed by the laws of India. The Courts of Delhi shall have exclusive jurisdiction to resolve any disputes arising out of your use of the Platform.

14. Grievance Redressal

If you are dissatisfied with the Services provided by LoPaisa, you have the right to file a complaint/feedback.
